Doing business with Council



Tenders

A local government must invite tenders before making a contract to carry out of work or to supply goods or services involving a cost of more than $150,000.

Detailed information

Tenders must be by invitation via an advertisement in a newspaper circulating generally in the local government area. Tenderers should allow at least 21 days from the day of the advertisement for the submission of tenders.


Principles governing the making of contracts

In entering into contracts with Council to carrying out work or supply goods or services, a local government must take into consideration the following principles:

  • open and effective competition
  • value for money
  • enhancement of the capabilities of local business and industry
  • environmental protection
  • ethical behaviour and fair dealing.


Exceptions from calling tenders

A local government may enter into a contract without complying with the rules governing inviting tenders when:

  • it resolves that it is satisfied that there is only one supplier reasonably available to it; or
  • it resolves that a genuine emergency exists; or
  • it resolves to obtain second-hand goods; or
  • it resolves to purchase goods at auction; or
  • the contract is made under an exemption to open competition in the Local Government Finance Standards; or
  • the contract is made with, or under an arrangement with, or made by: -
    • the state, a government entity, the Brisbane City Council or another local government; or
    • another Australian government, an entity of another Australian government or a local government of another State or Territory.

Panel of suitable providers

A local government may compile a panel of the names of persons suitably qualified to provide a service.

A panel must be compiled by:

  • inviting expressions of interest from persons to be included on the panel in the way provided for inviting tenders; and
  • selecting persons on the basis of the principles governing the making of contracts.
