New pool safety laws lambasted

The state government's new swimming pool safety laws have been bomb-dived by Animals and City Standards Committee Chairman, Councillor Graham Able (Division 5).

Cr Able said the new legislation, announced in late September, had missed the mark on the problem of children's safety around swimming pools.

"This new state government legislation is not targeting the major reasons why pool safety is a problem,'' he said.

"The focus should be on better educating parents how they can ensure their children are safe around swimming pools."

As part of the reforms, from December 1, all new residential pools will have to comply with tougher safety rules including mandatory CPR signage and safety inspections paid for by home owners.

Trees and other objects within 90cm of pool fences will have to be removed to ensure children can’t use them to climb over.

By late next year the second stage will require all pools to be inspected whenever a property is sold or leased.

The inspections are expected to cost between $90 and $130 and would be paid for by the pool owner.

All portable pools deeper than 300 millimetres will have to be fenced.

The changes, which replace 11 sets of pool safety rules in Queensland, follow the recommendations of an expert committee formed last year.

People with pools who do not sell or lease their home within two years of the new rules are expected to comply within five years.

Penalties for non-compliant pool fencing will remain the same, ranging from a $500 on-the-spot fine, to a $16,500 court penalty. The onus would remain on councils to enforce the new rules and hand out on-the-spot fines to homeowners who were found to not comply.

Cr Able said the new reforms would place financial strain on pool owners in Logan.

"As chairman of the Animals and City Standards Committee in Logan I know this is going to be very difficult for many pool owners who have complied with regulations in the past," he said.

"Some of the new compliances are interesting. For instance, under the old compliance if you had a door that had an automatic hinge that was automatically approved.

"Now you must have a fence around the entire pool and that's going to cost people a lot of money."
 
There are 22,102 swimming pools approvals recorded in Logan City. Only 8,074 of these swimming pools have received final approval.
