Noise nuisance in a residential area

Carrying out some building work for the home?
Operating at home any noise-generating equipment?
Make sure you do not cause a noise nuisance!
A residential noise can be a noise nuisance!

As provided in Logan City Council's Local Law No. 10 (Public Health) Part 2 (Nuisances), a person who causes a nuisance commits an offence and a nuisance is deemed to exist if, among other things, the noise emitted from his/her premises is a noise nuisance.

As specified in Local Law Policy No. 10.1 (Public Health) Part 4 (Noise Nuisance), a residential noise is a noise nuisance if it can be heard in a habitable room of an affected noise sensitive place after 7 pm and before 8 am (on a Sunday or public holiday) or 7 am (on any other day).

Some useful definitions:

A residential noise means noise from:

  • carrying out building works for residential premises (other than premises containing more than two dwelling units) or
  • the operation of an air-cooling/heating device, domestic cleaning equipment, a power tool, a domestic pool pump or a plant-cutting device.

A habitable room means a room where people may converse, study, work, relax or sleep.

A noise sensitive place means a dwelling; a library, childcare centre, kindergarten, school, college, university or other education institution; a hospital, surgery or other medical institution; a protected area, or an area identified under a conservation plan as a critical habitat or an area of major interest, under the Nature Conservation Act 1992; a marine park under the Marine Park Act 1982; a park or garden that is open to the public for use other than for sport or organised entertainment.

How can you help?

  • Don't work too early (before 8 am) or too late (after 7 pm) if the activity is generating noise.
  • Cut noise down while you work at home and help keep a healthy living environment for our community.

Penalty: Any person who causes a noise nuisance may receive an infringement notice from Council with an on-the-spot fine of $500. Alternatively, Council may issue the person with a compliance notice or a stop order. Any person who fails to comply with the requirements of a compliance notice or stop order is liable to a maximum penalty of $5,000 or $20,000 respectively.
