Fencing

In general, most fences do not require approval unless they are either swimming pool fences, or fences that are two metres above natural ground level. In these instances, you may require the approval of a building certifier.

You will find building certifiers listed in the yellow pages. You can read more about certification on the Building Services Authority web site.

You may need Council approval for certain fences where they are on a corner allotment. For further information, please contact Council's Customer Service Branch on 3412 5318.

Animal enclosure fences

All persons and animals are entitled to a safe living environment. By providing an adequate fence you will ensure that your dog remains on your premises and does not cause any potential threats or risk to the community.

Council has certain requirements regarding fences that are used as animal enclosures.

Barbed wire fences

Barbed wire fences are deemed to be a dangerous fence and a public nuisance in Logan City. These fences are prohibited where:

  1. the barbed wire fence is directly next to a park
  2. the barbed wire forming part of the barbed wire fence is within two metres from the ground level of the park
  3. the premises on which the barbed wire fence is erected is included in zones other than the Rural Zone and the Rural Residential Zone under the local government's planning scheme.

Barbed wire fences and electric fences are deemed to be dangerous fences in Logan City. In certain instances, these may require a licence under Local Law No. 9 (Licensing).

Dividing fences

The Dividing Fences Act 1953 (the state legislation regarding dividing fences) defines the law relating to constructing and repairing fences that divide adjoining land.

Generally, owners of adjoining land not divided by an adequate fence are liable to contribute equally to the cost of a dividing fence.

Electric fences

Electric fences are deemed to be dangerous fences in Logan City and may be required to be licensed under Local Law No. 9 (Licensing).

Fences on boundaries between a residence and parkland

Council is exempt from contributing to the cost of fencing under the Dividing Fences Act where the adjoining land is a public reserve, public park or land used for such other public purpose.

Swimming pool fences

The 1991 Pool Fencing Legislation requires that all owners of swimming pools for houses, flats and home units install and maintain a pool fence.

If you are building a new pool, you need to obtain approval from a Building Certifier. Please refer to the Yellow Pages for a Building Certifier close to you.
