The Logan City Council Open Data Portal has been developed to provide an easy to use site for the purpose of sharing and reusing of public data.

Terms and conditions

The Open Data Portal is owned and operated by Logan City Council. The main purpose of the portal is to encourage the community to use, share and reuse information that is publicly available and held by Council from time to time.

Council may update or modify these terms and conditions from time to time at its sole discretion. You should review these terms and conditions each time you access the portal.

Terms of use

These general terms and conditions govern your use of the Portal. Additional terms and conditions governing your use as well as notices, disclaimers and guidelines may apply to particular areas of the Portal or to particular features or transactions (additional terms). These general terms and conditions together with any other terms of use published on the Council website that also apply to your use of the portal, are referred to as the 'terms of use.

To the extent that these terms and conditions and any additional terms are in conflict with those on the Council website, these portal terms prevail in respect of the use of the portal.

Your access to and use of the portal, by any means, is subject to these terms of use.

Use of the portal indicates your acceptance of these terms of use.

Disclaimer, indemnity & limitation of liability

To the maximum extent permitted by law, the portal is provided by Council on an "as is" basis without any express or implied warranty of any kind.

Council does not warrant that access to or use of the portal will be uninterrupted or error free or that the portal or any material on or accessible through the portal is free from errors or viruses, worms, trojan horse or other harmful component.

Council does not warrant anything about the reliability, accuracy, completeness, timeliness, quality or suitability for a particular purpose of any material on or accessible through the portal. Council may change any of the material on the portal at any time without notice. You are responsible for assessing the accuracy, reliability, suitability and currency of the material on or accessible through the portal.

Intellectual property rights

The information, text materials, graphics, logos, button icons, video and audio clips, trade marks (whether registered or not), advertisements, layout, arrangement, graphical user interface, source code, schema, look and feel, and control features of the portal and any other content on the portal may be protected variously by copyright, trade mark and other intellectual property laws.

Subject to any Additional Terms, all content accessible on the portal is made available under the Creative Commons Attribution 3.0 Australia (CC BY 3.0 AU).

You must not otherwise modify, copy, reproduce, republish, frame, upload to a third party, communicate to the public, transmit or distribute in any way any of the material on the portal, including audio and video excerpts, except as expressly provided in these terms of use, or as permitted by the Copyright Act 1968 (Cth).

Access

Council may from time to time modify or discontinue, temporarily or permanently, the portal (or any part thereof), whether for maintenance or for any other reason, with or without notice. You agree that Council is not liable to you or to any third party for any modification, suspension or discontinuance of the portal.

Termination

Council may terminate this agreement and your access to the portal at any time without notice. In the event of termination you are no longer authorised to access the portal, but all restrictions imposed on you, licences and waivers granted by you and all Council disclaimers and limitations of liability set out in these terms of use will survive.

General

These terms of use are governed by the law in force in the State of Queensland and you agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and any other courts which may hear appeals from those courts in respect of any proceedings in connection with these terms of use or the portal.

If any of these terms of use are invalid or unenforceable, they will be struck out and the remaining terms will remain in force.

Council's privacy framework is designed to protect your rights and expressly governs the use of personal information on this portal.
