Statutory declarations for vehicle-related fines

Have you have received an infringement notice and you were not the driver or owner of the vehicle at the time of the offence?

You can lodge a statutory declaration nominating the responsible person for the vehicle at the time.

If you intend to nominate a responsible person do not pay the fine.

Once a fine is paid, the matter is finalised, and a declaration will not be accepted.

The declaration must be completed by the infringement notice recipient. We do not accept self-nomination declarations.

Statutory declarations are statements of fact and must be completed correctly and truthfully.

Things to get right when lodging a declaration

  • Submit the declaration within 28 days of the date the fine was issued.
  • You must provide the full name and correct address of the nominated person. Any mistakes will not be accepted.
  • The declaration must be witnessed by a Justice of the Peace, Commissioner for Declarations, lawyer, notary public or another person authorised to administer an oath under the Oaths Act 1867.
  • You should include the fine number and vehicle registration details on the declaration.
  • For a sold vehicle declaration, you MUST provide the date of sale or disposal of the vehicle.
  • For an illegal user declaration, you should provide the facts establishing the vehicle was stolen/illegally taken at the time. This should include the date the complaint was made to Police, which Police station or Policelink, and any Police crime reference number that may be relevant.
  • For an unknown user declaration, you must outline the steps you have taken to determine the responsible person. Merely stating you asked your family and friends if they were driving is unlikely to be accepted.

If your statutory declaration is accepted, the fine may be withdrawn and sent to the nominated responsible person.
