Statutory declarations for vehicle-related fines

Owners of vehicles that breach the Queensland Road Rules or local laws will receive a fine.

If you were not driving the vehicle at the time of the alleged offence, you can tell us who the driver was. The person who was driving may then be responsible for the fine. We do not accept self nomination declarations where drivers nominate themselves. The statutory declaration must be completed by the vehicle owner.

To let us know that you were not the driver, please fill in a Statutory declaration to Council (PDF 329 KB). Please tell us the circumstances, the name and address of the person driving the vehicle or the new owner.

The statutory declaration must:

  • be submitted within 28 days of the date the fine was issued
  • be witnessed by a Justice of the Peace or Commissioner for Declarations
  • state the name and current address of the person in charge of the vehicle at the time of the alleged offence
  • include the fine number and vehicle registration details.

If your statutory declaration is accepted, the fine may be withdrawn and sent to the person you nominated as the driver or the person in charge of the vehicle at the time of the offence.
