How do I apply for a roadside food vending licence?

Planning for the application

There are many public health and safety issues to consider when selecting a site for the roadside vending of food. 

When selecting a location, the site must be safe for the roadside vendor and for motorists stopping.

The operation of the roadside vending must not create a traffic problem, increase an existing traffic problem or detrimentally affect the efficiency of the existing road network. The ideal site will:

  • have road speeds of 60km or less
  • not be near:
    • intersections
    • traffic lights, or
    • traffic accident hot spots
  • not be on a busy road
  • have sufficient roadside shoulders and parking area, condition and width of road verges, and safe pull-off areas for decelerating vehicles
  • have clear long distant lines of sight, road type and condition, average speed environment and the driveable condition of the carriage way.

You may also need approvals from other agencies to operate on a State-controlled Road e.g. the Department of Transport and Main Roads.

Application process

First make sure the site has planning approval.

To apply:

  • download and complete the Application form – Roadside food vending (PDF 66 KB) and return it to us with payment.You can submit your application in person at our customer service centres, by post or email. Please see connect with us for our contact information
  • include a plan to scale of the operation including a layout plan with your application
  • include a copy of your public liability insurance.

Delays in the assessment and approval process will occur if you don’t include all of the required information.

You are responsible for ensuring the roadside vending approval application is complete. We will contact you if we need additional information to process the application.

We will notify you when a decision has been made about application.

When approved, you can then carry out roadside vending in line with the approved application.

We will inspect the site on a regular basis.

Public Liability Insurance

You must take out public liability insurance to a minimum value of $20 million and name Logan City Council as an interested party. A copy of this document must be submitted before your application is given approval.

You should also research other business insurance requirements.

Alterations/site additions

If you are making changes, you will need to download and complete the Application form – Roadside food vending (PDF 66 KB) to amend your licence.

If you add sites to your application after it is lodged additional fees may apply

Licence transfers

If you are buying a roadside vending permit, you will need to apply for a transfer of that permit.
