Do I need Council approval for each roadside vending location?

Roadside vending does not require Council approval for each individual site. Instead, permit holders must conduct their own site assessments and ensure compliance with the conditions of their permit.

Permit conditions provide rules that help vendors choose a suitable location, regulate the hours of operation, consider road safety and consider matters associated with the operation of the business.

Council officers respond to complaints and regulate permit holders, and failure to comply with permit conditions may result in penalties.

How is roadside food vending changing?

Currently, roadside vending businesses are required to apply for approval for each specific trading location. Under the changes, this process will be streamlined: permit holders will be authorised to operate from a public place, road, roadside or reserve without needing Council approval for each individual site provided the site meets certain criteria.

This new framework offers greater flexibility for vendors while upholding community standards and safety.

How do I choose a site to trade from?

As a permit holder, you will be responsible for conducting your own site assessments to ensure compliance with the conditions of your permit before trading.

This approach allows vendors to make informed decisions about suitable trading locations while maintaining public safety and amenity.

What happens if I don’t comply with my permit conditions?

Can I trade from a State-controlled Road?

If you would like to operate on a State-controlled Road, you will need written approval from the Department of Transport and Main Roads, in addition to your Council issued roadside vending permit. Please visit Department of Transport and Main Roads for more information.

What is a State-controlled Road?

Can I trade from a railway station carpark or on other Queensland Rail controlled land?

If you would like to operate on Queensland Rail controlled land, you will need written approval from Queensland Rail. Please visit Queensland Rail for more information.

Can I trade from sporting grounds / community halls?

Council-leased facilities include sporting grounds, commercial swimming pools, community halls, and various clubs where the premises are leased from Council for a defined period. To trade from any Council leased facility, you must first obtain permission from the lessee of the property.

Can I trade from a Council Park?

Yes, you will also need to complete a risk assessment before trading in a Council Park, in addition to holding a Council issued roadside vending permit. Please see Parks public event risk assessment guideline(PDF, 152KB) for the risk assessment template.

Can I reserve a site prior to arriving?

No, you are not permitted to reserve a location prior to arrival. This includes parking a vehicle, leaving a temporary stall, or placing any object at a trading site outside your approved trading hours.

Is there anywhere I cannot trade?

Can I trade from a commercial site or privately owned property?

To trade from a commercial location, such as a shopping centre carpark or shopping strip carparks, or vacant land but you will need approval from the landowner and you must ensure that you are complying with any Logan Planning Scheme requirements.

Can I trade from a Council carpark?

Trading can occur from a parallel parking space onto the curb side, if it does not impede pedestrians and complies with your roadside vending permit conditions. Trading from an angled or perpendicular parking space is prohibited.

Can I trade near another roadside vendor?

Assuming all permit conditions are met, no more than 2 roadside vending businesses can trade from a single site.
