Request for review of a fine (infringement)

Guidelines

The request for review needs to be submitted by the person issued with the infringement notice. 

The review will not be conducted if the infringement notice has been paid or a payment plan has been commenced. 

When you request that we review the decision to issue the infringement notice (fine), this is known as a ‘PIN review’. The PIN review will be investigated by a delegated Council officer. 

You can request to have an infringement notice reviewed if you believe you have a legal defence, an exemption from the law, there is an error on the infringement notice or there are exceptional circumstances. 

We reserve the right to refuse to withdraw an infringement notice at its discretion. 

Reasons not accepted

  • experiencing financial difficulty
  • did not know the law
  • stopped briefly and didn’t leave the vehicle
  • didn’t see the Traffic Area or Parking sign
  • stopped to make or answer a phone call
  • an appointment or meeting went for longer than expected
  • didn’t know your animal required registration
  • didn’t know the registration or permit had expired
  • didn’t know had to notify Council of a change to the registration details
  • didn’t know your animal was required to be contained or on a leash
  • didn’t know your dog had to be under effective control when in public
  • the animal escaped due to a gate left open or fencing in poor condition.

Timeframes

You must lodge your request for review in writing on the approved form as soon as possible. Reviews lodged more than 3 months after the infringement notice issue date will not be accepted. 

PIN reviews are typically completed within 25 business days of receipt. We appreciate your patience during this time and will notify you once your review is finalised. If you haven’t heard from us after 25 business days, please email Council@logan.qld.gov.au and provide the date you lodged the review and the infringement notice number.  

Requesting a PIN review does not stop you from electing to have the matter heard in a Magistrates Court. A court election must be received, in writing, within 28 days from the date of issue of the infringement notice

Please be aware if you choose to have a PIN review, the court election timeframe may have expired before the review decision is made. If this occurs, and you do not agree with the review decision, you will not be able to elect to have the matter heard in a court. 

Information required

You should provide supporting evidence when you lodge your review. Failure to provide any relevant evidence with the initial application means you risk a decision being made without all the facts and circumstances being presented. If there is no supporting evidence, the review may not be successful. 

For vehicle related fines

  • the grounds of any legal defence, exemption from the law, exceptional circumstance, or error on the infringement notice
  • vehicle repair invoices, spare parts or a towing receipt
  • a copy of a valid parking permit or disability parking permit
  • Documentation that confirms a medical emergency such as a medical report, hospital record etc
  • a statutory declaration from a witness, you can download a copy from the Queensland Courts website.
  • written advice or a crime report from the police
  • the infringement notice or a photocopy – if you don't have this, you can give us the:
    • fine number/s
    • vehicle registration number
    • date and time of the incident/s.

For animal related fines 

  • your animal’s full details, including:
    • animal registration number
    • animal name
    • breed and description
    • microchip number (if applicable) 
  • proof of current registration, renewal receipt or permit
  • proof of an animal being deceased
  • photos of your yard, enclosure, or fencing if the incident related to:
    • roaming
    • containment
    • aggressive interactions through fencing 
  • evidence that the animal was under effective control
  • vet documentation if the incident involved a deceased animal
    • a medical condition that contributed to the behaviour
    • an emergency requiring transport 
  • a statutory declaration from a witness outlining the incident
  • written advice or a report from police or Council officers if applicable
  • the infringement notice or a photocopy – if you don’t have it, provide:
    • fine number/s
    • animal registration number
    • date and time of the incident/s

Your options after our review 

When we reach a decision, we will send a letter to your postal address advising the outcome of the review. 

If your fine is not waived, you can: 

  • pay the fine in full to resolve the matter
  • apply for a voluntary instalment plan (for fines over $200) - must be received within 28 days from the date of issue of the fine
  • elect to have your case heard in the Magistrates Court (a court election) - must be received within 28 days from the date of issue of the fine.
