How Council manages personal information

Personal information is any information or opinion that:

  • identifies you directly, or
  • could be linked with other information to identify you.

The information or opinion does not have to be true for it to be considered ‘personal information’.

Council manages the personal information it holds in accordance with the Information Privacy Act 2009 (Qld) (IP Act) and the Queensland Privacy Principles (QPPs) contained within. These principles guide us on how we collect, store, use and disclose personal information.

Kinds of personal information collected by Council

Council conducts a diverse range of functions crucial to the provision of services to Logan City. The collection of personal information is a central part of many of these activities. The personal information Council will collect about an individual depends on the nature of the individual’s dealings with Council. We will only collect personal information that is necessary for us to do our work.

Personal information collected by Council includes, but is not limited to: 

  • Details including previous names, address history, gender, date of birth and marital status
  • License and permit information
  • Financial information
  • Digital photographs
  • CCTV footage
  • Aerial footage
  • Audio and/or visual recordings
  • Complaint details 

Council may collect information that is considered to be ‘sensitive’ only when the law permits us to. 

Privacy collection notice

Logan City Council may collect your personal information in order to conduct business and/or meet statutory obligations. If we are unable to collect the information we need from you, we may not be able to respond to your enquiry, complaint or request.

The information may be accessed by or transferred to business partners, contractors, employees and Councillors of Logan City Council and other government agencies for Council business related activities. Your information will be handled in accordance with the Information Privacy Act 2009 (Qld) and may be released to other parties where we are required or authorised by law to do so.

Identification options

When interacting with Council, you may be able to interact with us in different ways to protect your identity. These options include:

  1. Anonymity – no personal information (or contact details) are provided.
  2. Pseudonymity – you provide us with a name, term or descriptor instead of your legal name.
  3. Identifying yourself – using your personal information.

In each service, Council will provide an avenue for you to interact with us anonymously or through the use of a pseudonym unless we are exempt from doing so under the IP Act.

If you do choose to submit an anonymous customer request or a customer request using a pseudonym, and there are insufficient contact details (such as a phone number or email address) it may not be possible for Council to complete your request.

If you have previously corresponded with Council using your personal information, you can still use the same contact details to deal with through the use of a pseudonym in another matter. Council will only link the personal information we obtain to identify you if we receive your approval or if we are required to do so by law.

Ways we collect personal information and your identification options

Your personal information will be collected directly from you unless we are exempt from doing so under the IP Act. Council uses a variety of different methods, software and programs to collect personal information. The way in which you choose to communicate with Council may impact your ability to deal with us anonymously or through the use of a pseudonym.

There can be risks with giving information across the internet. Where our websites contain links to other websites that are not managed by Council, we are not responsible for the privacy or security practices or the content of those other websites.

Email

Identification options: pseudonym

When you email Council, your personal information is collected and retained where necessary in accordance with legislation. If you wish to use a pseudonym when emailing us, you must state this in the email so that we can correspond with you accordingly. When using a pseudonym, you should ensure that the email address you use and the information you provide to Council does not contain identifying information.

Telephone

Identification options: pseudonym and anonymous (in certain circumstances)

When you call Council, the personal information provided may be collected and retained where necessary in accordance with relevant legislation. Council will collect your phone number through our customer service phone system by automatically recording your phone number against the call recording.

If you wish to submit an anonymous request, you will need to call Council from a blocked number to prevent our system from automatically retaining it. When submitting the request with our customer service team, you will need to advise them that you wish to remain anonymous.

If you wish to lodge a customer request and your mobile phone number is recorded, it is still possible to use a pseudonym. When submitting the request with our customer service team, you will need to advise them that you wish to use a pseudonym.

Social Media

Identification options: Council cannot provide identification options as these sites are not owned by Council.

Council has official social media accounts established to reach and engage with the community. Any information that you provide to us through private messages on Council’s social media sites will only be used to perform our functions or activities. The information provided to us on these platforms is collected and retained in line with Council’s record keeping obligations. Users of these accounts must be aware of the individual social media site’s terms and privacy conditions prior to use.

Mobile Apps

Identification options: If these options are available to you, the app will feature information on how to remain anonymous or use a pseudonym.

Mobile applications or ‘apps’ are software programs designed to run on a smartphone, tablet computer or other mobile device. Council currently has a range of mobile apps that are capable of capturing personal information such as location, device or contact details. Users must be aware of the application’s terms and privacy conditions prior to use as not all mobile apps are owned by Council.

Cookie Data

Identification options: The cookies we use at Logan City Council have no way of disclosing your name or any information that could personally identify you.

Cookies are typically used to ‘remember’ the preferences of a device user and to analyse and improve our systems. Council may use cookies to record anonymous, non-personal information about a person’s visit to the Council website. Further information such as browsing activities may be collected including the pages visited, tools used and other such data.

We will not attempt to identify users or their browsing activities unless a law enforcement agency wishes to inspect the service provider's logs. This would only happen in the unlikely event of an investigation.

Feedback via website

Identification options: If these options are available to you, it will be advised on the feedback form.

Information sent to our website via the feedback link or email addresses will be treated as a public record and will be kept as required by the Public Records Act 2002 (Qld). Your name and address details collected this way will not be added to a mailing list without your consent.

Your email address will be recorded for the purpose of responding to your feedback or enquiry, or to provide confirmation of a transaction. Email messages may be monitored by our website support staff for system trouble shooting and maintenance. Any illegal activities suggested in the content of either feedback or emails will be forwarded to the relevant enforcement agency for investigation.

Online competitions

Identification options: N/A

Entries to online competitions will request the entrant's name, street address, email address and phone number. This information is not stored on the website and will not be added to a mailing list without the entrant’s consent.

Online forms

Identification options: If these options are available to you, it will be advised on the form.

Where online forms are available on our website, the personal information included on the form will be collected for the purpose stated on the form. However, that personal information will not be disclosed to others, except as set out in this privacy statement.

CCTV

Identification options: N/A

Logan City Council uses closed circuit television (CCTV) systems for 24-hour video surveillance within the city. Signs are displayed on CCTV cameras where they are being used.

Logan City Council collects information through the use of CCTV for the purposes of:

  • public safety
  • public officer disciplinary matters
  • law enforcement
  • crime prevention
  • detection and to effectively manage Council locations/assets.

All our CCTV recordings are made and handled in a way that complies with the IP Act and any other relevant legislation. The images captured by the cameras are stored securely and can only be accessed by authorised Logan City Council staff.

If an incident occurs and is captured by our CCTV cameras, relevant recordings may be provided to law enforcement agencies, including the Queensland Police Service and other organisations, to help with their investigations or enquiries. We may provide or show copies of recordings to third parties where we are authorised or required by law to do so. These recordings may contain personal information.

Mobility and Dash Camera Recordings

Identification options: N/A

Logan City Council uses personnel, vehicle and mobility platforms for camera recordings throughout the city, primarily for asset management purposes including operating, improving and research related to Councils assets and the road corridor. Signs are displayed on network survey vehicles where they are being used.

Our camera recordings are made and handled in a way that complies with the IP Act. Council regularly discloses camera recordings to Mapillary, university research facilities and consultants under contractual arrangements or where required by law.

Body worn cameras and audio recording devices

Identification options: N/A

Council’s compliance officers use body worn cameras (BWCs) and/or audio recording devices when they are carrying out functions as a ‘law enforcement agency’ as defined by the IP Act. Council is committed to treating personal information with respect and, as such, compliance officers will only record images and sounds when exercising a legislative power.

Audio recordings

Identification options: N/A

Logan City Council collects your personal information automatically when you enter our waste facilities through the use of audio recording devices. Signs are displayed at the relevant locations to advise you of this.

Drone recording devices

Identification options: N/A

Council’s officers use remotely piloted drones in many locations throughout the city for law enforcement, marketing, emergency and disaster management, infrastructure assessments and environmental monitoring. Any time a drone captures still picture or video footage of an identifiable individual, it is potentially capturing personal information. Council’s compliance officers ensure that imagery is not recorded in circumstances where a reasonable person would expect to be afforded privacy.

Service providers

Identification options: If these options are available to you, the service provider will give you these options.

Council uses contracted service providers to perform various functions for the community. In order for the provider to carry out these services, they may be required to collect and use personal information on Council’s behalf.

Why Council collects your personal information

Council only collects your information if it is necessary for us to carry out one of our functions. When we collect your personal information, we will take reasonable steps to ensure that you are aware of:

  • The purpose or reason for the collection and the circumstances (if relevant)
  • If collection is required or authorised by law
  • The main consequences if we don’t collect your information 
  • If we usually disclose your information to anyone (within Australia or overseas)

You will also be provided with a link that will outline to you:

  • How you can contact Council
  • How to access and correct your information
  • How you can make a privacy complaint

If Council receives information about you that we don’t need, reasonable steps will be taken to destroy or de-identify it in accordance with the law.

How Council uses and discloses your information

When we are corresponding with you, Council will use the contact information you provide to us to check that your customer record is accurate, up to date, and complete. Council’s customer records are centralised and used by all areas of Council to conduct business and provide services to you.

In most circumstances, your information will only be used and disclosed in accordance with the notice provided to you at the time we collected it. For example, this may include using or disclosing your information to:

  • banks or other financial institutions to process payments
  • courier companies if we are required to deliver something to you
  • our professional advisers, contractors or service providers who advise us or carry out our functions and activities
  • your representatives (for example your authorised representatives or legal advisers)
  • Other government agencies if your request or correspondence is unable to be actioned by Council and another government agency is better equipped to assist you

If we need to use or disclose it for another reason, it will be in accordance with the IP Act. This may be, for example:

  • Council is required or authorised to do so by law
  • The information is required by a law enforcement agency like the Queensland Police Service (QPS)
  • You have given us your consent
  • It is necessary to reduce or prevent a threat to life, health or safety

Whenever your information is used or disclosed, it is only what is necessary to carry out the service or function. We will take reasonable steps to ensure that any third party we disclose your personal information to is also bound by privacy obligations.

Artificial Intelligence

Council may use artificial intelligence (AI) technologies to enhance customers experience, improve service delivery, secure information and for other business-related purposes. Council uses purpose-built systems that are integrated with AI. Appropriate checks and assessments are undertaken to ensure that the use of AI is safe, ethical and responsible. All use of AI is subject to human oversight.

Disclosure of personal information outside of Australia

Council adheres to section 33 of the IP Act when disclosing information outside of Australia. Council ensures that appropriate privacy assessments are conducted prior to the transfer of personal information outside of Australia.

Securing your personal information

Council will take reasonable steps to ensure that the personal information we hold about you is protected. Council will do this in the following ways:

  • Requiring that internal staff adhere to terms, conditions, policies and frameworks that aim to protect your information.
  • Implement and maintain various corporate systems to hold your personal information in a secure way.
  • Assess systems to ensure that the appropriate technical and physical safeguards are in place.

Council uses corporate systems and devices that may be housed locally within the City of Logan or cloud based 

Making a privacy complaint 

If you believe that Council has not dealt with your personal information in a manner that is consistent with your expectations or requirements under the IP Act, a privacy complaint can be made within 12 months of the event.

A privacy complaint can be made in relation to a failure to comply with: 

  • The Queensland Privacy Principles
  • Any relevant QPP code applicable to Council 

How to make a privacy complaint

Privacy complaints made to Council must: 

  • Be in writing
  • Include an address of the complainant
  • Give particulars of the act or practice which is the subject of the complaint 

Privacy complaints can be submitted by post, email, in person at our service centres or over the telephone. Reasonable help will be provided where required to assist you in putting your privacy complaint in writing.

How Council deals with privacy complaints

Complaints will be acknowledged in writing within 5 business days from the date the complaint is received. Once investigated a decision will be made as to whether the complaint is substantiated within 45 business days. 

Where we need more time to investigate a complaint, we will contact you to explain why we need more time. Once your complaint has been investigated, we will provide you with a written decision.

Council facilitates both formal and information ways for you to access and amend your personal information.
