Accessing information

Overview

There are a few ways you can:

  • Get access to documents or information held by us.
  • Amend your personal information

Publication scheme

We maintain a publication scheme webpage, which gives a complete overview of our organisation and describes our relationship with the Logan community. You can access the following information in our Publication scheme.

Administrative access

Councils Administrative Access to Information Policy(PDF, 431KB) provides an avenue for people to request access to documents and information informally. We will only withhold information where the law says we cannot give those documents to you or where your request is more suited to a formal application under the Right to Information Act 2009 (RTI Act).

Anyone can ask for copies of documents under the Policy, there is no guarantee that access will be given to you.

How to apply for documents

The way you apply for documents will depend on what you are applying for and how you wish to be identified. You can request access by applying in writing, by email, in person or by post.

Application for your own personal information

Identification options: You must identify yourself when requesting your own personal information. 

You need to give the following information to us:

  • your full name
  • your contact details, including phone number, email or address
  • what information or documents you are seeking

You will also be required to provide us with evidence of your identity. If you choose to apply in writing, by email or by post your identity documents must be certified. If you apply in person, you may bring certified identity documents with you or you can have them sighted by Council.

Application for documents that contain no personal information

Identification options: Pseudonym only as we will be required to correspond with you to obtain your application and provide you with an outcome.

You need to give the following information to us:

  • How you would like us to contact you if we need to speak with you about your request
  • How you wish to receive the information (email, post or picking it up from the Council building)
  • What information or documents you are seeking

Right to Information applications

Access to Information

Identification options: For applications containing no personal information, you are able to use a pseudonym. This is the only option available to you as we require an address to correspond with you. For applications containing personal information, you are required to identify yourself as the legislation requires you to provide your personal information.

To request documents containing person and non-personal information, a formal application can be made under the Right to Information Act 2009 (RTI Act).

The RTI Act promotes the release of information by us unless this information is exempt, or its release would be contrary to the public interest.

For an access application to be valid, it must be accompanied by the application fee. There is no application fee for applications that solely request access to your own personal information. 

The access application must: 

Access applications for documents containing personal information of the applicant, the application must also include: 

  • Evidence of applicant identity
  • Evidence of agent authority (if applicable) 

If you are applying by email or post, your identity documents must be certified. If applying in person, you can bring certified copies or have them sighted by Council.

Amendment of personal information

Identification options: You are required to identify yourself as the legislation requires you to provide your personal information.

If you have had access to a document and your personal information within it was inaccurate, incomplete, out of date or misleading you can make an amendment application to Council under the RTI Act.

There is no application fee associated with an application to amend your personal information.

The application for amendment must: 

  • Be made in writing
  • Have sufficient detail to allow document identification
  • State an address to which notices may be sent
  • Be accompanied by evidence of identity
  • Be accompanied by evidence of agent authority (if applicable)
  • State the way in which the applicant claims the information is inaccurate, incomplete, out of date, or misleading
  • If the information is claimed to be inaccurate or misleading – state the amendments the applicant claims are necessary for the information to be accurate or not misleading; and
  • If the information is claimed to be incomplete or out of date – state the other information the applicant claims is necessary to complete the information or bring it up to date

If you are applying by email or post, your identity documents must be certified. If applying in person, you can bring certified copies or have them sighted by Council. 

Evidence Act applications

If you are party to civil legal proceedings and you think that we hold information relevant to an issue in the proceedings, you may request information under section 134A of the Evidence Act 1977. For more information about how to make an Evidence Act application, please call us on 07 3412 3412.
